2. Accounts and Use Rules

- Using bots, scraping, or automation against our Services without written permission
- Misrepresenting affiliation with Nyxhora or any third party
2.3 Paid Features and Third-Party Providers
Some features may require payment or subscription. Pricing, billing cycles, and plan limits are disclosed at checkout.
We may use third-party processors or infrastructure providers. Your use of those services may be subject to their own terms, and you are responsible for reviewing those terms where applicable.
3. User Content and Listings
3.1 Your Content
You retain ownership of content you create, upload, publish, or submit. You grant Nyxhora a non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, transmit, display, and adapt that content solely to operate, maintain, secure, and improve the Services.
You represent that you have all rights and permissions necessary to submit your content and listings.
3.2 Nyxhora Content
The Services, including software, branding, interface, trademarks, and underlying materials, are owned by Nyxhora or our licensors and are protected by applicable intellectual property laws. Except as expressly permitted, no rights are granted to you.
3.3 Community Listings, Explore Surfaces, and External Servers
Some areas of the Services may display user-submitted or third-party listings, including templates, communities, integrations, links, servers, tools, or other resources ("Third-Party Listings").
Nyxhora does not own, operate, control, or guarantee Third-Party Listings unless explicitly stated. Displaying a listing does not mean endorsement, certification, partnership, or warranty.
Your interactions with third parties are solely between you and the third party, and are at your own risk. Third-party terms, privacy policies, and security practices apply.
3.4 Listing Warranties, Moderation, and Takedown
If you submit content or listings, you warrant they are accurate, lawful, non-infringing, and do not contain malware or deceptive claims.
We may review, de-index, remove, disable, or refuse any listing or content at any time, with or without notice, and without assuming a duty to monitor all content.

4. Enforcement and Termination
We may investigate violations and take action including warnings, content removal, listing removal, feature limits, suspension, or termination of access.
We may terminate repeat infringers or users that create legal, operational, or security risk. Provisions that should survive termination will survive, including ownership, disclaimers, indemnity, and liability limits.
5. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
WE DO NOT GUARANTEE THAT THE SERVICES, OR ANY THIRD-PARTY LISTING SHOWN THROUGH THE SERVICES, WILL BE SAFE, ACCURATE, LEGAL, AVAILABLE, UNINTERRUPTED, OR ERROR-FREE.
6. Indemnity and Liability
You agree to defend, indemnify, and hold harmless Nyxhora, its affiliates, directors, employees, and licensors from and against claims, damages, liabilities, losses, and expenses (including reasonable legal fees) arising out of or related to your content, listings, use of the Services, violation of these Terms, or violation of any law or third-party right.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NYXHORA WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS INTERRUPTION. NYXHORA'S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO NYXHORA IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR (B) INR 5,000.
7. Changes to Terms
We may update these Terms from time to time. Changes are effective when posted unless a later date is stated.
If you continue to use the Services after changes become effective, you accept the revised Terms.
8. Governing Law
These Terms are governed by the laws of the Republic of India, without regard to conflict of law principles.
Subject to applicable law, courts in Bengaluru, Karnataka, India will have exclusive jurisdiction over disputes arising from or relating to these Terms or the Services.
